  1. Agreement

By accessing indigenouscanada.org (the “Website”) you agree that you have read, understood, and agree to be bound by these terms and conditions (the “Terms”).

You may only access the Website if you are over the age of majority in the province or territory in which you reside or you are under the age of majority and your parent or guardian agrees to be bound by the Terms on your behalf and consents to your access to and use of the Website.

Investments Ltd., doing business as INDIGENOUSCANADA (the “Company”) reserves the right to revise the Terms at any time without notice.  By accessing the Website you agree to be bound by the current version of the Terms.

If you are using the Website on behalf of any entity, you represent and warrant that you are authorized to accept the Terms on such entity’s behalf and such entity shall be bound by the Terms.

  1. Acceptable Use

         Job Seekers

The purpose of the Website is to connect indigenous job seekers (“Job Seekers”) with Canadian employers (“Employers”).  You may only access or use the profile, resume upload, and job application features of the Job Seekers Page to respond to Employers about employment opportunities, which the Employers have posted on the Website.

You agree that the information contained in your profile, resume and job application accurately describe your experience, education and identity and are not exaggerated, incorrect or untruthful.

The Company reserves the right to edit or remove any profile, resume or job application which is not in accordance with the Terms without prior notice.

The Company reserves the right to deny in our sole discretion any person from accessing the Website or any portion thereof without prior notice.

The Company makes no warranties or representations regarding the truthfulness, accuracy, correctness, reliability or otherwise with respect to the information contained on this Website.

           Employers

The purpose of the Website is to connect indigenous job seekers (“Job Seekers”) with Canadian employers (“Employers”).  You may only access or use the resume or personal information of Job Seekers for the purpose of contacting Job Seekers about employment opportunities.

You agree that you will not submit any job posting to this Website which is: (a) False or misleading; (b) A pyramid scheme or multi-level marketing opportunity; (c) Sexual in nature or related to any of the following: escort services, prostitution, erotic dancing, or erotic massages; (d) Related to modeling or talent searches; (e) Libelous, defamatory, abusive, threatening or an invasion of privacy; (f) Obscene or pornographic; (g) In violation of any law; (h) Advocating any illegal activity; (i) Advertising or otherwise soliciting funds; (j) Selling goods or services; or (k) An infringement of any intellectual property or other right of any entity or person, including, but not limited to violating anyone’s copyrights or trademarks. (the “Prohibited Content”).

The Company reserves the right to edit any job posting for clarity or length and to modify or remove any Prohibited Content from the Website without prior notice.

The company reserves the right to share some job postings with partner networks and websites.

The Company reserves the right to deny in our sole discretion any person from accessing the Website or any portion thereof without prior notice.

The Company makes no warranties or representation regarding the truthfulness, accuracy, correctness, reliability or otherwise with respect to the information contained on this Website.

  1. Limitation of Liability

In no event shall the Company and its affiliates or any of their respective directors, officers, employees, agents, content providers, other representatives, successors and assigns be liable for any direct, indirect, special, incidental, consequential, punitive, or aggravated damages (including without limitation damages for loss of data, income or profit, loss of or damage to property, third party claims, disclosure of confidential information or loss of privacy) or any other damages of any kind, arising out of or in connection with: the Website, any information, forms, agreements, and documents available through the Website, any termination of access to the Website and the services; any software tips, tools, products or services offered through or advertised on the Website; any content, materials, act or practice of any third party provider; any link provided on the Website; any trojan horses, bugs, viruses and the like; deletion, corruption or failure to store any data; your failure to provide correct, accurate and up-to-date information; and your account and password  or your failure to keep them secure, whether or not  the Company has been advised of the possibility of such damages. This exclusion of liability shall apply to the fullest extent permitted by the law. This provision shall survive the termination of your right to use this Website.

You acknowledge and agree that you will be fully liable for all damages resulting directly or indirectly from your use of the Website.

  1. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates and their respective directors, officers, employees, agents, content providers, other representatives, successors and assigns from and against all claims, liabilities, losses, damages, suits, actions, costs and expenses (including legal expenses) relating to or arising out of your use of the Website including the transmission or placement of information or material by you on the Website. This provision shall survive the termination of your right to use this Website.

  1. Jurisdiction

The Terms are governed and interpreted under the laws of the Province of British Columbia. If any portion of these Terms is deemed, unlawful, void or unenforceable, then that part shall be deemed severable and will not affect the validity and enforceability of any remaining provisions.
